1. Introduction

Welcome to RPGLMS ("the Service"), a gamified learning management system operated by Surrealdente ("we," "us," or "our"). By accessing or using our mobile applications, web application, or any related services, you agree to be bound by these Terms of Service ("Terms").

RPGLMS transforms learning into adventure through RPG-style quests, AI-powered content generation, and collaborative classroom features. These Terms govern your use of all RPGLMS products and services.

If you do not agree to these Terms, please do not use our Service.

2. Eligibility

Age Requirements

  • Individual Users: You must be at least 13 years old to create an individual RPGLMS account.
  • Educational Settings: Teachers, parents, and guardians may create accounts on behalf of students under 13 as part of a supervised classroom or homeschool environment. In such cases, the supervising adult assumes responsibility for the student's use of the Service.
  • Parental Consent: If you are between 13 and 18 years old, you represent that you have your parent's or guardian's permission to use the Service.

3. Account Registration

To use certain features of RPGLMS, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities under your account

You may sign in using third-party authentication providers (such as Google or Apple). By doing so, you authorize us to access certain account information from those providers as permitted by their terms of service.

4. Subscription Plans and Billing

Available Plans

RPGLMS offers the following subscription tiers:

  • Apprentice (Free): Basic access for students and learners. Join classrooms, participate in quests, and track personal progress. Limited AI features.
  • Sage ($9.99/month or $79.99/year): For teachers and content creators. Unlimited Campaigns, 2M AI tokens per month (individual cap), join Houses to collaborate, and full Campaign management tools.
  • Master ($19.99/month or $159.99/year): For PLC leaders. Create your own House (auto-created on upgrade), Unlimited Campaigns, 5M AI tokens per month (individual cap), shared Campaign Hub for collaboration, analytics dashboard, and priority support.
  • Enterprise (Custom Pricing): For districts and organizations. Custom quotas, SSO integration, compliance features, and dedicated support. Contact us for pricing.

Billing

  • Subscriptions are billed in advance on a monthly or annual basis through our payment processors (Apple App Store, Google Play Store, or RevenueCat for web).
  • Annual subscriptions include a discount equivalent to two months free.
  • Prices are subject to change with 30 days' notice to existing subscribers.

Refund Policy

Due to the digital nature of our Service and the immediate access provided upon purchase, we generally do not offer refunds for subscription payments. However:

  • Refunds required by applicable law (such as consumer protection laws in your jurisdiction) will be honored.
  • For subscriptions purchased through Apple App Store or Google Play Store, refund requests must be submitted directly to Apple or Google according to their policies.
  • If you experience technical issues that prevent you from using the Service, please contact support@rpglms.com and we will work to resolve the issue or provide appropriate compensation.

Cancellation

You may cancel your subscription at any time. Upon cancellation:

  • You will retain access to paid features until the end of your current billing period.
  • Your account will automatically downgrade to the free Apprentice tier.
  • Your content and data will be retained for 90 days, after which it may be deleted.

5. Service Description

RPGLMS provides:

  • Campaign System: Organize courses as epic adventures with Campaigns (courses), Paths (modules), and Nodes (lessons) containing Investigations, Engagements (mini quizzes), and Reports.
  • Party Features: Create Parties (classrooms) with unique join codes, manage Players (students), and facilitate collaborative learning. Game Masters can assign Party roles (Player, Observer, NPC).
  • AI-Powered Content: Generate Engagements, Trials (path quizzes), Rifts (campaign quizzes), Investigations (content resources), and Reports using artificial intelligence.
  • Progress Tracking: Shards (XP points), Renown (social currency), achievements, leaderboards, and analytics to monitor learning outcomes. Progress persists across Parties at the Campaign level.
  • Gamification: RPG-style elements including Avatars, Mobs (path challenges), Campaign Bosses, GemHearts (path completion rewards), and Story Settings with narrative themes to enhance engagement.

6. Acceptable Use

You agree NOT to use RPGLMS to:

  • Violate any applicable laws or regulations
  • Infringe upon intellectual property rights of others
  • Upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the Service or servers
  • Use automated means to access the Service without our permission
  • Collect personal information about other users without consent
  • Use the AI features to generate inappropriate, harmful, or misleading content
  • Share account credentials or transfer your account to another person

We reserve the right to suspend or terminate accounts that violate these terms.

7. User Content

Your Content

You retain ownership of content you create using RPGLMS (campaigns, quizzes, learning materials, etc.). By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display your content solely for the purpose of providing the Service.

AI-Generated Content

Content generated by our AI features is provided for your use within the Service. You are responsible for reviewing and editing AI-generated content before using it with students. We do not guarantee the accuracy, appropriateness, or curriculum alignment of AI-generated content.

Content Moderation

We may review content to ensure compliance with these Terms and applicable laws. We reserve the right to remove content that violates our policies.

8. Intellectual Property

The RPGLMS name, logo, and all related graphics, software, and content (excluding user-generated content) are the property of Surrealdente and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, or create derivative works based on our intellectual property without our prior written consent.

9. Third-Party Services

RPGLMS integrates with third-party services including:

  • Apple App Store and Google Play Store (app distribution and payments)
  • RevenueCat (subscription management)
  • Google and Apple (authentication)
  • AI service providers (content generation)

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the actions or policies of third-party providers.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. We do not warrant the accuracy or reliability of any AI-generated content.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STUDIO AUGUSTUS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Surrealdente and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

13. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your account and all associated data
  • Provisions that by their nature should survive termination will remain in effect

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts located in Travis County, Texas.
